Does the new (2010) HUD-1 get signed?
There are no signature lines on the 2010 HUD-1, does anyone know who if anyone needs to sign this document?
The link to the latest hud on HUD's website is: http://www.hud.gov/content/releases/hud-1.pdf
You can verify that there isn't a request on any of the three pages for signatures!
Are we allowed to modify the HUD-1 and add signature lines?
Signature pages on the new 2010 HUD
RESPA apparently will still not care about the signature pages of the HUD...HOWEVER the Department of Insurance sure does.
Most likely the softwear you are using for your new HUD's will take into account the regs within your state and add a fourth page or "signature block"
to the third page of the 2010 HUD. I went through the RESPA training all day here in Houston and signatures were a big hot button. It is basically up in the air, as is quite a few other HUD 2010 issues right now. Rest assured, by the time your first closing rolls around in Januar, 2010 the borrowers will be signing some sort of discolsure at the table.
Signatures on 2010 HUD
Bill,
You are good at spotting what's missing on a HUD!
Just like today, there is no RESPA requirement for either borrower or seller to sign the HUD-1 or HUD-1a form.
Several states have requirements for signature, as does most of the secondary market. Therefore, acknowledgement by the parties signature and date has become a matter of practice in most areas.
The HUD-1 and HUD-1a forms can be modified to include signature blocks.
